New Bankruptcy Opinion: In re Age Refining, Inc., Bankruptcy Court for the Western District of Texas, Case No. 10-50501 | Issue: Reconsideration of Approval of Fees for Chapter 11 Trustee

Upon a motion for reconsideration of the bankruptcy court’s approval of the Chapter 11 Trustee’s Fifth & Final Fee Application, the United States Trustee argued that the Chapter 11 Trustee’s services should have stopped on the effective date of the confirmation of the reorganization plan in the case and, therefore, that the bankruptcy court erred in allowing the Chapter 11 Trustee’s application for fees incurred after that date.  The bankruptcy court disagreed, but did limit the Chapter 11 Trustee’s fees incurred after the Trustee filed a motion for discharge, finding that there was nothing left for the Trustee to do at that point.
