Although no parties in interest objected to the Application, there are several reasons the Court believes it is appropriate to review the Order: (1) the Order was entered before the case was transferred to this District; (2) in this District, local rules do not require the appointment of a claims/noticing agent; (3) the U.S. Trustee in this District has not had an opportunity to review and comment upon the application for the appointment of a claims/noticing agent; (4) any new counsel for the Debtor may not want to use a claims/noticing agent; and (5) the case is reported to be a liquidating case with limited assets, and the retainer paid to the claims/noticing agent is relatively high compared to the value of the assets and the number of claims, given that in this District, creditors may file claims directly with the Court. The Court on its own motion STAYS the Order Granting Application for Order Appointing Rust Consulting/Omni Bankruptcy as Claims and Noticing Agent for the Debtor Nunc Pro Tunc pending further Court Order. The Court grants the U.S. Trustee and interested parties who had not already been served with notice of the Application or had the opportunity to object 14 days to object to the Application.
